General Terms and Conditions for Radio Bury Competitions

These General Terms and Conditions apply to competitions and prize draws promoted by Radio Bury Community Interest Company ("Radio Bury"), unless the specific rules for a competition state otherwise.

By entering a Radio Bury competition, entrants agree to these General Terms and Conditions together with any additional terms announced on air or published for that particular competition.

1. Competition-specific terms

Each competition may have additional terms setting out matters such as:

  • how to enter;
  • the opening and closing date and time;
  • eligibility requirements;
  • any restriction on the number of entries;
  • details of the prize;
  • how the winner will be selected;
  • how and when the winner will be contacted; and
  • any other significant conditions applying to that competition.

Where competition-specific terms conflict with these General Terms and Conditions, the competition-specific terms will take precedence.

2. Eligibility

Unless otherwise stated in the competition-specific terms, entrants must:

  • be aged 16 or over at the time of entry; and
  • be resident in the United Kingdom.

Radio Bury may impose different age or geographical restrictions where appropriate to a particular competition or prize. Any such restrictions will be made clear when the competition is promoted.

Where a prize is intended for, or may be won by, someone under the age of 18, Radio Bury may require the consent of a parent or guardian and may impose additional conditions appropriate to the prize.

3. Entries

Unless otherwise stated, only one entry per person is permitted.

Entrants must not use multiple identities, accounts, telephone numbers or other methods intended to circumvent an entry limit.

Entries made through organised syndicates, automated entry services, scripts, bots or other mechanisms designed to generate multiple entries may be disqualified.

4. Information supplied by entrants

Entrants must provide accurate information when requested.

Radio Bury may require information reasonably necessary to administer a competition, verify eligibility or deliver a prize, including an entrant's name, telephone number, email address, postal address or proof of age.

Providing false or misleading information may result in disqualification.

5. Employees, volunteers and conflicts of interest

Unless expressly permitted in the competition-specific terms, the following people may not enter:

  • directors, employees, members or volunteers of Radio Bury who are directly involved in the competition;
  • anyone directly involved in administering, producing or judging the competition;
  • employees or representatives of a prize provider or other organisation directly involved in the competition; and
  • immediate family or household members of any of the above where their participation could reasonably give rise to a conflict of interest.

Radio Bury may disqualify an entrant where it reasonably believes that a conflict of interest exists or that the integrity of the competition could otherwise be affected.

6. Receipt of entries

Proof that an entry, message, email, form or other communication was sent does not constitute proof that it was received by Radio Bury.

Radio Bury cannot accept responsibility for entries that are lost, delayed, corrupted, incomplete or not received because of technical failures, communications failures or other circumstances outside its reasonable control.

7. Technical or operational problems

If a technical, operational or other problem affects the fairness or proper conduct of a competition, Radio Bury may suspend, amend, postpone or cancel the competition where reasonably necessary.

Any decision will be made with the aim of maintaining fairness to entrants and compliance with applicable broadcasting and promotional rules.

Where reasonably practicable, Radio Bury will explain any significant change affecting entrants.

8. Fairness

Radio Bury will conduct competitions fairly and will take reasonable steps to ensure entrants are not materially misled.

Competition rules and significant conditions will be made available clearly and appropriately.

Prizes will be described accurately.

9. Closing dates

Entries received after the advertised closing date or time will not normally be accepted.

Radio Bury will not change a closing date merely to encourage further entries.

A closing date may be changed where circumstances outside Radio Bury's reasonable control make this necessary, or where another legitimate reason exists and the change does not unfairly disadvantage entrants.

10. Selection of winners

The method used to select a winner will be appropriate to the type of competition.

For a prize draw based on chance, winners will be selected using a fair random process.

Where entries are judged on skill, creativity, knowledge or other stated criteria, entries will be judged against the criteria announced for that competition.

Radio Bury may use independent supervision or independent judging where appropriate or required.

The decision of Radio Bury or the appointed judges regarding the result will be final, subject to applicable law and regulatory requirements.

11. Contacting winners

Radio Bury will make reasonable efforts to contact a winner using the contact details supplied with their entry.

Unless otherwise stated, a winner may be required to respond within a reasonable period specified when they are contacted.

If a winner cannot be contacted after reasonable attempts, does not respond within the specified period, cannot establish their eligibility, or declines the prize, Radio Bury may select another winner where appropriate.

12. Prizes

Prizes are subject to any restrictions or conditions stated in the competition-specific terms.

Unless otherwise stated:

  • prizes are non-transferable;
  • no cash alternative is available; and
  • a winner may not request a different prize.

Radio Bury will make reasonable efforts to provide the advertised prize.

If a prize becomes unavailable for reasons outside Radio Bury's reasonable control, Radio Bury may provide a reasonable equivalent of similar value where appropriate.

13. Third-party prizes

Some prizes are supplied or fulfilled by third parties.

Where a prize is supplied by a third party, the winner may be required to comply with reasonable terms imposed by that supplier.

Radio Bury is not responsible for the acts or omissions of an independent prize supplier where these are outside Radio Bury's reasonable control. This does not affect any rights an entrant or winner may have under applicable law.

14. Prize restrictions and expenses

Unless expressly included in the prize description, expenses associated with accepting or using a prize are the responsibility of the winner.

For example, a ticket or event prize does not include travel, accommodation, food or other expenses unless these are specifically stated to be included.

Any dates, booking restrictions, age restrictions, accessibility requirements or other material limitations applying to a prize will be stated where applicable.

15. Disqualification

Radio Bury may disqualify an entry where it reasonably believes that:

  • these terms or the competition-specific terms have been breached;
  • an entrant has attempted to manipulate or unfairly influence the competition;
  • an entrant has submitted fraudulent, automated or duplicate entries;
  • information supplied by an entrant is materially false or misleading; or
  • allowing the entry to stand would compromise the fairness or integrity of the competition.

Disqualification decisions will be made reasonably and on the information available at the time.

16. Publicity and announcement of winners

Radio Bury may announce competition winners on air, on its website or through its social media channels.

Where required for the administration and transparency of a promotion, Radio Bury may publish or make available limited information demonstrating that a valid prize award took place.

Entrants will be informed where a competition involves additional publicity requirements.

Radio Bury will not require a winner to participate in unreasonable promotional activity as a condition of receiving a prize unless that requirement was made clear before entry.

17. Photographs, audio, video and other submitted material

Entrants retain copyright in original material they submit unless the competition-specific terms expressly state otherwise.

Where an entrant submits photographs, audio, video, written material or other content as part of a competition, the entrant grants Radio Bury a non-exclusive, royalty-free licence to use that material as reasonably necessary to administer, promote and report on the competition across Radio Bury's broadcast, website and social media services.

The entrant confirms that they have the necessary rights and permissions to submit the material and to grant this licence.

Any materially different use will require appropriate permission.

18. Personal information

Radio Bury will process personal information supplied in connection with a competition in accordance with applicable UK data protection law and the Radio Bury Privacy Notice.

Personal information may be used to:

  • administer the competition;
  • verify eligibility;
  • contact entrants or winners where necessary;
  • arrange delivery or fulfilment of prizes;
  • investigate suspected misuse or breaches of the competition rules; and
  • comply with applicable legal or regulatory obligations.

Where necessary to fulfil a prize, relevant information may be shared with the organisation supplying or delivering that prize.

Entering a competition does not automatically consent an entrant to receive marketing communications from Radio Bury or a third party. Any consent for marketing will be requested separately where required.

19. Social media competitions

Where a competition is operated through a third-party platform such as Facebook, Instagram, TikTok or another social network, entrants must also comply with the applicable platform rules.

Unless expressly stated otherwise, such competitions are not sponsored, endorsed, administered by or associated with the relevant social media platform.

20. Cancellation or events outside Radio Bury's control

Radio Bury may suspend, alter or cancel a competition where circumstances outside its reasonable control make it impossible, unsafe, unlawful or unfair to continue as originally advertised.

Any action taken under this provision will be proportionate to the circumstances and, so far as reasonably possible, will avoid unfairly disadvantaging entrants.

21. Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so.

Subject to this, Radio Bury will not be responsible for losses resulting from circumstances outside its reasonable control or for indirect or consequential losses arising from participation in a competition or acceptance of a prize.

Entrants and winners remain responsible for deciding whether a prize is suitable for them and for complying with any lawful conditions attached to its use.

22. Changes to these terms

Radio Bury may update these General Terms and Conditions from time to time.

The version applying to a competition will normally be the version in force when that competition opens.

Radio Bury will not make a material change to the rules of a competition after it has opened unless there is a legitimate reason to do so and the change can be made fairly and consistently with applicable regulatory requirements.

23. Regulatory requirements

Radio Bury competitions will be operated subject to applicable law and regulation, including, where relevant, the Ofcom Broadcasting Code and UK rules governing promotional marketing, prize competitions and free draws.

Nothing in these terms overrides any statutory or regulatory rights or obligations.

24. Governing law

These terms are governed by the law of England and Wales.

Nothing in these terms affects any mandatory legal rights that an entrant may have.
